Some concerns have been brought up about Guild Bank ownership at the World of Warcraft forums. Interslayer introduced some very interesting scenarios that could happen to the Guild's leader and therefore the concerns for the Guild Bank was brought up.
Blizzard poster Hortus quickly responded to Interslayer's questions, explaining that most of the scenarios he brought up couldn't happen in the game. Here are the scenarios brought up:
- What happens to a guild bank if the guild is disbanded?
- Or if the guild leader moves to a new server?
- What if guild leadership is transferred to another character?
- What if the guild leader character is deleted?
- If a guild is disbanded, and the bank is lost, can you get the
contents back by reforming under the same guild name with the same
character?
- What happens if someone else takes the name before you can reform?
- Does the guild bank stay intact if the guild leader character is banned from the game or otherwise inactive?
According to Hortus, the scenarios are moot since there are already precepts in action or enforced so these won't happen, saying:

You can not delete or transfer a guild leader character so those scenarios can not happen.
- If leadership of a guild is transferred the new leader now has full access to the guild bank.
- If the guild is disbanded the current guild leader gets all the items in the bank via his mailbox.
- If the guild leader was banned, you would most likely need to contact a GM to get leadership transferred.
